Wheel Clamping: Support Garnet Grey’s Fight Against the Clampers
7 November 2008
I have been very interested to receive news from Mr Garnet Grey, whose car was wheel-clamped by a company from Walsall that goes by the name of Elite Parking Control.
This company clamped and removed Mr Grey’s vehicle in May 2008, and demanded a payment of 450 pounds. Mr Grey could not afford to pay such a high charge to get his car back, and refused to do so. The clamping company has retained Mr Grey’s car in its compound, and has told Mr Grey that they are charging him storage fees for this of 50 pounds per day.
Instead of agreeing to pay the extortionate charges that Elite Parking Control wanted him to, Mr Grey has initiated legal action against the clamping company.
Mr Grey’s court case is due to be heard in either November or December of 2008. I welcome Mr Grey’s initiative in bringing legal action against a clamping company, as I believe it is effectively a test case, which could set a valuable legal precedent if Mr Grey is successful in his action. It was a similar legal action in Scotland that led the courts there to rule car clamping on private land illegal. Although the Government has plans substantially to reform the regulation of clamping on private land in England & Wales that will be brought forward by the end of 2008, it is unlikely that the practice will be outlawed.
I have been campaigning for wheel clamping to be outlawed for sometime (click here for more information) and therefore I fully support Mr Grey in his action, and I think it is in everyone’s interest to do so. Mr Grey is likely to face significant legal costs in bringing this action. If you would like to help Mr Grey by making a contribution to his legal costs, please contact him at this email address: garnet.grey@yahoo.co.uk
